Reproductive Coercion as Domestic Violence

Presented by Honorable Mark A. Juhas

California has a 40-year history of protecting domestic violence victims and survivors. The legislature recently made two significant additions to Family Code section 6320; effective in 2021 the legislature statutorily defined “coercive control” and beginning in 2022 the legislature further expanded coercive control to include reproductive coercion.  Reproductive coercion is a relatively new addition to the law, although there has been significant discussion of it in medical and academic literature.  This addition to the law may prove to add substantial protection, as well as substantial opportunity for litigation.
